New trial ordered for man on 8 murders in 1982

Posted: Updated:

WOBURN, Mass. (AP) - A Massachusetts man who has spent three decades in prison has been granted a new trial in a 1982 fire that killed eight people.

Victor Rosario's attorneys had argued that there were serious flaws in the investigation that led to his 1983 conviction for arson and eight counts of murder.

In a ruling Monday, Middlesex Superior Court Judge Kathe Tuttman cites developments in fire-science investigation and questions about whether Rosario's confession was voluntary. She says justice wasn't done.

Lawyers for the 57-year-old Rosario praised the decision.

The Middlesex district attorney's office tells The Sun (http://bit.ly/1oj5RJL ) it's reviewing the ruling.

Prosecutors say Rosario and two other men who have since died set the fire in Lowell as payback for a bad drug deal. The eight victims included five children.
