Former WSC student asks for new trial in friend's murder

AMHERST, MA (WSHM) -

A former Westfield State College student convicted of killing his longtime friend in his off-campus apartment at Umass Amherst wants the state's highest court to grant him a new trial.

Bryan Johnston was convicted of murder in the 2004 shooting death of his friend, David Sullivan, and is serving a life sentence.

During his trial, Johnston's lawyers claimed he was insane when he shot Sullivan six times. Prosecutors said Johnston was angry Sullivan had been ignoring him.

Johnston's lawyer argues in his appeal that errors by the judge and his trial lawyer unfairly cut away at Johnston's legitimate insanity defense.

The supreme judicial court is scheduled to hear Johnston's appeal Friday.
