Mother responds to Henrico school worker’s arrest

The mother of a Henrico school worker accused of taking inappropriate pictures of a student at Freeman High School says her son told her someone took his phone.

Joshua Brinkley, 22, is a former Freeman High School basketball star turned teacher's aide. He is now accused of taking inappropriate pictures of a student at school.

Brinkley's mother says the Freeman High graduate and Delaware University basketball standout was planning to go overseas to play basketball, but injuries prevented the trip. She says her son then decided to return to his alma mater working 29 hours to "give back to the youth." She says he was actively looking for a second job.

Henrico Police say Brinkley took a photo of an 18-year-old male student's genitalia while at Freeman last week. Henrico Schools confirm Brinkley worked as a temporary instructional assistant and works with students who have special needs.  Brinkley is now charged with non-consent: filming or videotaping an undressed person.

Brinkley's mother says her son told her this week that someone had taken his phone. She says he suggested something may have happened at school, but she was surprised to read the formal allegations on NBC12.com.

Police say the incident dates back to November 15.

HCPS released this statement:

"We consider the privacy and safety of our students to be a top priority, and we are treating the accusation seriously. We also must let the legal process run its course before making any additional comments specific to this incident.

The parents of the affected student have been notified. We also will offer to meet with any additional parents who express their concerns."
