New Law May Release Unclaimed Remains

"Even if a person is in a cremated form, it's still a person," says Darlene Willey Sliwa, Owner of the New England Funeral and Cremation Center. "And it's really no different than if a person were in our facility in a casket.

But some families don't understand that after choosing cremation their responsibility does not end. Because of confusion, grief or even denial funeral homes are often left with unclaimed ashes they can't dispose of.

"Legally that is not our responsibility," says Willey Sliwa. "It is the responsibility of the next of kin."

The governor is currently reviewing a bill that would give funeral homes a legal alternative. If ashes remain unclaimed for one year, the funeral directors can choose to bury them or scatter the ashes in a local cemetery. An option not all funeral directors want.

"We should not be caring for cremated remains, we are not the next of kin." says Willey Sliwa.

That's why the owners of the New England Funeral and Cremation Center came up with their own solution, preceding the potential state law.

"A family who arranges for cremation understands that they must pay a security deposit, 100-percent refundable when they come to pick up the remains," says Willey Sliwa.

An incentive that seems to work.

"We do not have any," says Willey Sliwa. "And at our other facility we probably only have two."

The governor has until Sunday to make a final decision on the bill.
