Parks Prohibit ATV Riding

24 year old Casey Fennyery lost his life Saturday night when his ATV struck a tree in Robinson State Park. It's a wooded trail frequented by illegal riders. The Department of Conservation and Recreation prohibits ATV use in all but six state parks.

"Four of them are here in Western Massachusetts," says DCR Commissioner Rick Sullivan. "Beartown, Pittsfield, October Mountain and Tolland, and then two in the Central, Eastern part of the state."

The trails are monitored, but the Sullivan says it's a problem that won't stop without cooperation from the riders themselves.

"We do have rangers that certainly can be out there enforcing some of the rules," says Sullivan. "But we certainly can't be all places at all times."

The commissioner says safety is always a concern, but the department also looks at environmental factors when making decisions on trail use.

"We look at a lot of factors including size, the use of the facility, what the trail system is like, what the wildlife is like," says Sullivan.

Even though Robinson prohibits ATV use, riders say these trails extend beyond the park boundaries, and you can get on a trail from the outside and ride in undetected.

"It is always a little bit of a tricky problem, and we need to make sure to see if those trails that have been built up are even legal trails," says Sullivan.

And as the investigation into the weekend tragedy continues, the commissioner says this accident may actually lead to increased ATV trails, so riders have a safe and legal place to ride.

"We may be able to have new trails in new facilities, so we're not always saying you can't do it here," says Sullivan. "But you can do it here where it is appropriate."
