17-year-old Justin Jackson was arrested Saturday night after police say he stole a woman's car at the Shell Gas Station on Bay and State Streets with her child strapped in a car seat.

In court we learned the suspect and the child's mother actually knew each other. Jackson's attorney says he was in the car, but didn't steal it.

"He says yes he was in the car with her and the child, she dropped him off at Burger King and that was that, he never drove he was walking. She gave him a ride, did not take the car, didn't know about the child, " says Jackson's attorney.

But the child's mother, Mary-Jane Stanley, told police a much different story. She says she was giving Jackson a ride. When they stopped to fill up, she says he drove off. Police found the car and the child outside of Jackson's home on Stebbins Street. Moments later Jackson was walking the streets near the Dunbar Community Center.

The child was found unharmed, but is now in DSS custody. Jackson was originally charged with kidnapping and larceny, but that kidnapping charge was dropped. He's being held on $10,000 bail.
