Holyoke Cops in Court

The charges have been changed but Holyoke Police Officers Joseph Wilson and Sean Shattuck are still on trial.

Instead of assault and battery with a dangerous weapon they're now facing the lesser charge of simple assault and battery after an incident last December.

Christopher Martinez's defense attorney says the pictures speak for themselves.

On December 18th Martinez says he was attacked for no reason by Holyoke Policemen Joseph Wilson and Sean Shattuck at the Sportsmen's Bar in Holyoke.

Wilson and Shattuck's Attorney, "You'll hear testimony from people who were in there, a bartender who was working there from other patrons that they were trouble."

Martinez's Attorney, "The police officers when they are off duty have no right to assault someone or throw their weight around because this isn't the wild wild west."

But police say Martinez is a frequent offender and was just involved in another altercation at a Holyoke bar this past weekend.

Wilson and Shattuck's Attorney, "He's a fighter, look at him, he's a fighter and your going to see a picture of his face that night which I'm submitting to you and it looks swollen which is not much different than he looks all the time."

Martinez's Attorney, "He's going to tell you he knows how to fight but he didn't fight back in the bar our outside and you know why, he'll tell you that he knew they were Holyoke police officers and he didn't want to get involved with Holyoke police officers."

But according to Wilson and Shattuck that's just what he did that night which forced them to retaliate.

Wilson and Shattuck's Attorney, "Finally he took another swing at Sean Shattuck and at that time Shattuck hit him once or twice maybe three times I'm not sure and Joseph Wilson grabbed him and they brought him to the ground on a snow bank."

The trial is expected to last three days and both officer Joseph Wilson and Sean Shattuck are expected to take the stand.
