Woman Says Rights Violated When Arrested For Videotaping Protest

Through song, and words, dozens gathered on Greenfield's town common to show support for Emily Peyton and to stand up for civil liberty.

Peyton was arrested last month for video taping a man, known as Uncle Sam, sitting on top of a sign in Greenfield protesting the war. She says she was sitting in her car taping that protest when police started arresting several people. She caught the act on tape, but was then quickly arrested and charged with illegal wiretapping. "Their decision to arrest came out of the blue for me," says Emily Peyton of Vermont.

Police argue she was trying to conceal her camera by sitting in her car, but Peyton says it weighs about six pounds and is more than a foot long, making it hard to hide. "Cameras are subject to drop out on film if it's real cold, so I was in my car heating it up," Peyton argues.

Uncle Sam, and several others marched to Greenfield District Court to support Peyton. They say her arrest symbolizes a breech of their own first amendment rights. State wiretapping law forbids secret recording of people's conversations. But Peyton still wants to know what she did wrong. "We need to be able to record events because of the Rodney King beating was recorded and because that was recorded a lot of justice happened," adds Peyton.

She's now trying to get her case dismissed, and working to get back what she lost. "We need our freedom of rights, we need to get them back," says Peyton.
